The ALEC Revolution: Extremism of the 1990's

That's kinda been my attitude - that they were a bunch of conservative losers until the mid 90's and that is when they became the extremist pro-corporate American Legislative Exchange Council.

And they WERE extremists in the mid 90's.
I have to share with you what Lyndon LaRouche
(I know - I know - he was fringe - but so is ALEC, so who better to comment on them.)

An address to the same conference by Rep. Harold Brubaker of North Carolina, the immediate past national chairman of ALEC, is typical of the lies and Confederate propaganda which interweave American Legislative Exchange Council literature. Brubaker was sounding the theme that the only legitimate government is that government created by state legislatures, and therefore, state legislatures should see themselves as sovereign and superior to the federal government.

"Indeed," he said, "it is the states that created every government in the nation. And the states themselves are the creation of the people. . . . Constitutionally, the United States and its entire federal structure are the creation of state legislatures. " 
For 20 years the American Legislative Exchange Council and its allied National Taxpayer/> Union (NTU) have been spreading the call for a constitutional convention (an effort which came dangerously close to success during the Reagan presidency), for the explicit purpose of undermining the general welfare and equal justice clauses of the Constitution. The latest permutation is the campaign to "revive the Tenth Amendment" which is all the rage among populists and their radio talk show hosts. Like the "unfunded mandates" and "balanced budget" issues, this latest fad is the carefully cultivated work of ALEC and !the collection of thieves, mobsters, and multinational cartels which are funding the populist movement.

ALEC proposes that states create a Constitutional Defense Council, funded by the state treasury, and other sources, to organize challenges to "the Authority granted to, or assumed by, the federal government" and to conduct "any other activity that is deemed appropriate by the Council."
At the December conference in Washington, Larry Pratt of the ALEC-affiliated Gun Owners of America, openly called for the creation of state militias which should be prepared to do battle with the Army of the United States. Pratt is associated with Ambrose Evans-Pritchard, and his zombie Larry Nichols, who has made violent threats against President Clinton.
And it's evident
ALEC doesn't know what the hell they are talking about
ALEC produces model legislation urging state governments to revolt against the "unfunded mandates" of the federal government. According to studies which underlie the legislation, there is no reliable, quantifiable, definition of what "unfunded mandates" are or what they cost---
while they plan this revolution - funded by corporations - led by their soldiers in each state legislature and by their Alumni in the US Congress.

Mo Money Fuels ALEC's Mandatory Minimums Change of Heart

ALEC is getting a huge amount of press - for something that they should not be getting press for
Monday, the conservative, corporate-backed group adopted model legislation that would reform draconian mandatory minimum prison sentences, according to Families Against Mandatory Minimums, which sponsored the legislation.  

The ALEC Board of Directors passed a version of the Justice Safety Valve Act, a bipartisan bill introduced in both houses of Congress to give judges discretion to reduce statutory minimum sentences that impose onerous sentences for a range of drug and other crimes, FAMM Florida Project Director Greg Newburn told ThinkProgress.

ALEC doesn't do anything for anybody except it's corporate members!
People - the ones from zygotes -
  are not part of ALEC's agenda - 
  ALEC legislators have no concern for us 
  and ALEC legislators do not legislate for us.
NEVER!

Oh, well, you really don’t need people to do this. You just need control over the legislature and you need money, and we have both.”

That sentiment was underscored so many times to me, that they don’t want people involved in the political process, or in the policy process.
Giving ALEC or subsequently ALEC legislators
 - Kudos - or press time - 
for this new legislation
is premature 
until we can identify ALEC's true, ulterior, for-profit motive for this legislation.

One possible ulterior for-profit motive is illustrated in an email exchange I had with Bob Sloan, Director of the Voter's Legislative Transparency Project. - who has written extensively on ALEC's private prison legislation. 

My question to Bob was - 
Why would ALEC all the sudden do this, back away from mandatory minimum prison sentences?  Especially when ALEC has spent decades writing legislation to establish for-profit prison systems and then distributing ALEC "tough on crime" legislation that put more people in prison - financially benefiting ALEC corporate private prison members.

And his answer came back to - increased corporate profits - 
   And you can be sure there is an ALEC Corporate Member who will benefit.
   
Here is his response - in it's entirety - shared with you with Bob's permission - to enlighten you that all may not be as it seems, with ALEC (or IMO with Eric Holder's motives).
   ...  it’s easy NOW for ALEC to jump on this proposed legislation, with so many states verging on bankruptcy brought about in part by the high annual cost of incarcerating.  

What FAMM and others who now are praising ALEC fail to understand is that ALEC wrote and pushed all the legislation responsible for our overcrowded prisons and court systems…as a way of profiting off of crime and criminal justice policies.  

Now they are proposing that instead of state sanctioned parole (which they helped abolish state by state) be resurrected – but in a way to allow profiting off of releasing the same low level offenders they targeted until the last year or so. 

The parole they suggest is a “post conviction bond” paid for by the offender or his/her family and friends, issued by a member of the American Bail Coalition (ALEC long time member).  

Once issued, the offender is required to wear a GPS device (built by an ALEC friendly corporation) and monitored by a private company (another ALEC sponsored company) – and in the end, the private bonding company has complete control over if/when to violate an offender and simply pick him/her up and return them to prison.  After all the bonding company has already made their money off those they return, and the then move on to the next victim.

If states were not in such dire straits financially, ALEC and the “Right On Crime” bunch headed by Gingrich, Jeb Bush and other staunch conservatives would continue to call for stiffer criminal penalties and new laws to incarcerate as many as possible.

Did Protesters Outnumber ALECers 10 to 1 in Chicago?



Earlier this week I posted an entry where I question the numbers that ALEC is putting out to the public.
In their press release for the meeting in Chicago ALEC state:
State Legislators, Business Leaders Meet in Chicago
Chicago, Ill. (August 7, 2013)—More than 1,200 state legislators, business leaders, citizen groups and policy experts from around the country gather today in Chicago
Note that the statement of 1200 attendees includes:
      legislators, business leaders, citizen groups and policy experts
they forgot to mention spouses, kids, legislative staff members and ALEC staff members

This morning I found an article on the National Conference of State Legislatures, or NCSL.
In that article it states:
About 5,000 people attended the four day Summit in Atlanta. Of those, 1,000 are elected state legislators.
Ohhhhh- honesty in reporting.
1,000 were elected state legislators

So if you figure that 20% of the people at NCSL were legislators – it would not be illogical to presume that the attendance of legislators at ALEC was similar – 20%.

If you take ALEC’s original statement
More than 1,200 state legislators, business leaders, citizen groups and policy experts from around the country gather today in Chicago
20% of that would represent 240 legislators

Which, by the way – is the approximate number of legitimate, verifiable, original (not electronic) signatures that ALEC got on their rebuttal letter to Durbin – after ALEC staff spent two days scrounging for signatures – at the ALEC 40th anniversary annual meeting.

Therefore – I feel confident in deducing
That protestors at the Chicago protest
outnumbered ALEC legislative members by a number of 10 to 1.

The extremist pro-corporate American Legislative Exchange Council may claim 2,000 legislative members - but it is evident that from OKC and Chi that only 10% of their members are probably active.

Unfortunately for us - that 10% is the most extreme
Unfortunately for us - that 10% is the most extreme who pass corporate written legislation at ALEC meetings and make that legislation available for dissemination across the US.
Unfortunately for us - the other 90% are unethical plagiarizers who copy and paste ALEC corporate written legislation without impunity.

Is ALEC LYING About Membership Numbers?

Let’s crunch some numbers on ALEC legislators:
Civil Justice Task Force  - 168 members
Commerce – 214 members
Communications and Technology – 181 members
Education – 181 members
Health and Human Services - 247 members
International Relations – 106 members
Public Safety and Elections – 151 members
Tax & Fiscal Policy – 228 members

50% are corporations (788)

That means
553 ALEC members who are task force members

OOOOPS!!!!!!
ALEC BRAGS that they have 2,000+ legislative members
And yet only 500+ are task force members

Only about 500+ PEOPLE will be at the meeting in Oklahoma City today and tomorrow.
That includes the ALEC profit sector members

500 legislators would ONLY be 25% of 2,000+ ALEC legislative members.

NOW – even if we are generous and say 300 of the 500 PEOPLE attending the meeting in OKC are ALEC legislative members – that would be ONLY 15% of ALEC legislators -

15% of the total ALEC members making legislative decisions for all ALEC members.

15% of the total ALEC members developing the nasty ALEC “model legislation” that is distributed across the United States

15% lousy percent
That is really embarrassing.

We’re not even talking a quorum here – unless they consider the quorum to be the ALEC Profit Sector members.

Do these 15% of all ALEC members represent the most extremist, ultra-conservative, right-wing members that the American Legislative Exchange Council has?

Pretty sad, so sad
 – when this meeting according to ALEC is to:
During the meeting, legislators will introduce and debate potential model policies that will have a positive impact on the American economy
They should say - During the meeting, only 15% of ALEC legislators will introduce and debate  ....

Pretty sad.

Important to remember that.

Anyhow - last Tuesday - 8/6 the day before the ALEC Annual Meeting started Dick Durbin wrote a letter to all ALEC corporations (for profit, non-profit, trade association, lawyers, etc) inquiring if they were a member of ALEC at the time that ALEC was pushing Stand your Ground across the United States.  He did this in preparation of the US Senate hearings on Stand your Ground to start next month.

Durbin pi$$ed off every member of ALEC - how dare he ask for people to verify their membership.
ALEC is a secretive extremist right wing organization - they do not share member information with anyone - now or forevermore.

ALEC was pi$$ed.  They got the lawyers of ALEC corporate members (already at the meeting with briefcases of legislation) to write a rebuttal letter to ALEC - On August 8th - 2 days after Durbin made his request and 1 day before the ALEC Annual Meeting was over.

They only got 262 ALEC signatures on that letter to Durbin - at the meeting - while everyone was there - in the middle of the event.

You would think - YES, you would think that every ALEC legislative member in attendance at the meeting would have signed that letter.

Yet - they ONLY GOT 262 ALEC signatories on the letter - AT THE MEETING.

Were there only 262 ALECer willing to sign the letter of outrage to Durbin?
OR
Were there only 262 ALEC legislative members at the 40th Anniversary Meeting of the American Legislative Exchange Council?

I think it was the latter.
I think ALEC is lying about the legislative membership numbers.

Between 225 - and 300 ALEC members at the May Meeting.
Between 262 to 300 ALEC members at the August meeting.

Total Revenues in 2011 for memberships/dues
TOTAL revenues for memberships/dues
$ 97,321
and that includes corporate memberships - cause there is no separate line items for legislators and a separate line for corporations  (remember corps pay between $2,500 and $25,000 to belong.)

ONE-TENTH of ALECs supposed members making decisions for ALEC.
225 - 300 ALEC members making decisions for the United States of America.

ALECer Misleads Public About ALEC.

Found this tweet exchange yesterday:

After the conversation - Sara Marie blocked Superguts.
For a "internet marketing guru"  - she evidently lacks the ability to defend her stance on things.


She is wife of Ohio State Rep. Andrew Brenner - an ALEC Member
And she is own little tornado of controversy.
She is on the City Council of  Powell, OH - with some controversy about past tax liens against the business held by her and her husband.  And it got nasty.   And it got even nastier when people were asking her to resign from the City council over this.
She is currently embroiled in an interesting online (aka public) discussion of her work history.

If you google her name - she has her fingers in a lot of different stuff - ambitious in what appears to be an A.D.D. type of way.

But the key here is what she was saying in her online radio broadcast - 3 1/2 minutes form the ALEC Meeting in Chicago.
 
She explains what ALEC is - the wife of an ALECer - at the ALEC meeting - goes onto the internet to pimp for ALEC.

Nowhere in the radio blog report she mention that Corporations are sitting next to those ALEC members at that meeting.
Nowhere in that radio blogspot does she mention that Corporations brought in briefcases full of legislation that they want ALEC to pass.
Nowhere in that radio blogspot does she mention that corporations paid to have the legislators brought in to the ALEC meeting.
Nowhere does she mention in that radio blogspot that ALEC legislators are no better than whores - coming to Chicago to lay down before their corporate masters.
Intentionally misleading the public - becauseshecan.
And because she got a free trip out of it - to a posh hotel in chciago where she and her husban were wined and dined by corporate lobbyists.

Will ALEC Diss a Sitting US Senator?



It all started here two weeks ago:

The Senate’s No. 2 Democrat will hold a hearing on “stand your ground” laws this Fall.
Dick Durbin of Illinois announced on Friday that his Senate Judiciary subcommittee will hear testimony on state laws that give citizens the right of lethal force to defend themselves in situations where they feel their life is threatened, measures which are on the books in some form in dozens of states.

Durbin’s hearing will probe the roles of the NRA and ALEC — which helps draft conservative legislation in statehouses —

And that, at the time – was all good and well

But then Durbin wanted to know more!

In preparation for a previously announced hearing       Sen. Richard J. Durbin, D-Ill., sent letters to more than 300 possible corporate backers of ALEC, requesting their position of such policies in states across the country.

The letter, released by Durbin’s office, says the following:

    “I write to seek information regarding your company’s position on “stand your ground” legislation that was adopted as a national model by an organization called   ...  (ALEC),” Durbin wrote. “In 2005, ALEC approved the adoption of model ‘stand your ground’ legislation entitled the ‘Castle Doctrine Act.’ This model legislation was based on Florida’s ‘stand your ground’ law, and it changes the criminal law regarding self-defense and provides immunity for certain uses of deadly force.

    “Although ALEC does not maintain a public list of corporate members or donors, other public documents indicate that your company funded ALEC at some point during the period between ALEC’s adoption of model “stand your ground” legislation in 2005 and the present day. I acknowledge your company’s right to actively participate in the debate of important political issues, regardless of your position, and I recognize that a company’s involvement with ALEC does not necessarily mean that the company endorses all positions taken by the organization. Therefore I am seeking clarification whether companies that have funded ALEC’s operations in the past currently support ALEC and the model ‘stand your ground’ legislation.”

And it’s important to remember that most of those 300 companies were at the ALEC meeting in Chicago and most of them (including the NRA) paid ALEC money to be at the meeting – behind closed doors, influencing your state legislators.
And while ALEC were in Chicago, meeting behind closed doors with those very corporations – this happened.

Then Durbin turned up the pressure on ALEC corporations

The editorial page of Thursday's Wall Street Journal reported that the senator has sent letters to corporate and nonprofit supporters of ALEC, asking them to disclose their positions on "stand-your-ground" legislation that ALEC supported in Florida in 2005.

ALEC, which is holding its annual meeting in Chicago this week, is a conservative association of state legislators, foundations and businesses that advocate limited government and free markets. Many but not all of its areas of focus are economic.

Durbin's communications director, Max Gleischman, told us Thursday afternoon that the senator's goal isn't to silence groups he opposes, but "to find out if groups that support (ALEC) financially agree with (ALEC's) position on 'stand your ground' laws. Simple as that."

And while ALEC were in Chicago, meeting behind closed doors – this happened.
The pushback from ALEC members.


  ...  ALEC  ...is fighting back against Senate Majority Whip Dick Durbin’s push to get companies associated with the group to hand over information over its support of “stand your ground laws.”

 “Members and donors to 501(c)3 organizations are specifically protected by the Internal Revenue Service and the Supreme Court to shield them from the type of political intimidation found in Sen. Durbin’s letter,” said ALEC first vice chair and Iowa Majority Leader Linda Upmeyer, in a statement.

Oh – there is that 501c3 arugment – we are a nonprofit – for now anyhow.

“Although ALEC does not maintain a public list of corporate members or donors, other public documents indicate that your company funded ALEC at some point during the period between ALEC’s adoption of model ‘stand your ground’ legislation in 2005 and the present day,” Durbin wrote.

He added that he was seeking “clarification whether companies that have funded ALEC’s operations in the past currently support ALEC and the model ‘stand your ground’ legislation.”

Information we would all like to know.

And today - the right wing histrionic responses are getting more extreme.  Extremism - what you will find when dealing with members of ALEC

Is it his job to tell citizens and groups what sort of policies they may advocate? What about tracking down all the members of that group?

“Why not just ask it: are we now or have we ever been members of the American Legislative Exchange Council?”

Some may cringe - but I think that's a righteous question - and an appropriate question for a gorup that is intentionally destroying the democratic representative government - of, for, and by the people.
